The family of Dr. Omar Owan, who perished in a fire following a crash in 2019, is now taking legal action, asserting that a malfunction in his Tesla Model S contributed to the accident. In February 2019, Dr. Owan collided with a tree, causing the vehicle to ignite upon impact. Emergency responders faced difficulties accessing the vehicle due to the absence of functional door handles, which were meant to automatically deploy in emergencies but failed to do so.
A spokesperson from the police, in an interview with NBC 6 News, stated, "They attempted to break the window to rescue the individual, but were unsuccessful. The flames were too intense at that stage."
During the same interview, a Davie police officer who investigated the incident consulted with a Tesla specialist regarding the door handles. The expert indicated that, "They are designed to auto-present during a crash. However, if power is suddenly cut, the electronic handles won’t function. There is a mechanical backup, but it can only be accessed from inside the car. This is why the company trains first responders to break the window to gain entry."
The family has now initiated a lawsuit against Tesla, contending that the design of the vehicle was "defective" and contributed to Dr. Owan's demise. They argue that he "might have survived" if the door handles had functioned correctly. The lawsuit claims that the car presents an "unreasonably dangerous fire risk" due to the failure of the door handles, labeling it a "death trap."
In a heartfelt moment during the NBC 6 interview, his wife described Dr. Owan as a "very supportive" individual and the "backbone of the family." She expressed her grief, stating, "He was only 48. We have young children. No one deserves to die in such a manner. He could have been saved and should have been here with us... with his kids."
Tesla has refuted all claims made in the lawsuit, maintaining that the vehicle was "state-of-the-art and built to meet industry standards."
